Is patent worth it?
Hi, peers,
have been selling a product for some 7 years now. Was first on the market with the product (has to do with bedding). I had consulted with an IP lawyer and she advised I do not get a patent, because the product was too easy to tweak and then the whole (costly) patent would be useless. Today I have tons of no-name competitors selling the same thing, and even copying my text, on which I worked hard to put together 7 years ago. Lazy asses just find something that sells well on Amazon and copy the whole concept. And so even if I had a patent… What could I do with it? Sue these people? They are probably mostly from China, where my product is manufactured, maybe my business partners shared my concept with their peers, who knows… I’ll never know… Even if I wanted to sue them, I don’t believe the patent would be enforceable in foreign countries like China, for example.
I’m now designing a new product (again in the bedding category). Not sure I should get a patent. What good could it do if I had it? Cost would be very high, which would mean I would need to sell a ton of these bedding things to compensate for it. And then, the concept will be copied by many, and then what? Please confirm with me that I shouldn’t bother with the patent. 🙂
