Prop 65 Warning Lerer
I sold FBA between 2020-2022 and was never a high volume seller. I was surprised to receive this letter (pasted below) and am wondering if there is anything I should worry about. I am not planning to sell on Amazon again in the future.
Doll Amir & Eley LLP writes on behalf of Amazon.com, Inc. in connection with the above- captioned matter. As you know from our earlier correspondence, Amazon was named in the aforementioned lawsuit for allegedly violating California’s Proposition 65, Cal. Health & Safety Code § 25249.5, et. seq. Specifically, the lawsuit alleged that various third-party sellers, including you, were selling products to California consumers in the amazon.com store without proper Proposition 65 warnings. Amazon has entered into a Consent Judgment to resolve the lawsuit and, pursuant to it, is required to “notify in writing all vendors and third-party sellers of the Covered Products of the legal requirement to provide the Section 2.1(b) warning statement for each Covered Product online, and that the California Attorney General requires that vendors and third-party sellers of the Covered Products that are subject to Proposition 65 also apply the Section 2.1(b) warning statement, or a Proposition 65 compliant warning, directly on the packaging of the Covered Products.” This letter serves as your notice of the above. Please be reminded that the governing terms and conditions of your agreement(s) with Amazon require that you place proper Proposition 65 warnings on the product description pages for all products you sell in the amazon.com store that require such warnings, and you are contractually obligated to defend Amazon against, and indemnify Amazon for, any claims or losses it may suffer as a result of your failure to comply with those warning obligations. Amazon recommends that you consult with legal counsel of your own choosing to ensure compliance with Proposition 65.
