Potential Registered Design Misuse (Lightning) – Best way to address
Was recently slapped with a Potential Registered Design Misuse Lightning (Lightning) violation on a couple of my several amazon listings selling iPhone Chargers of various colors and lengths. The whole violation came as quite the surprise – I order them via an Apple MFI certified supplier and do not use any reference to “Lightning” anywhere on the product itself, albeit in the product description. A reminder that this is a patent, not a trademark. Therefore the primary concern relates to the product itself, not the wordage.
When speaking with Amazon Seller Support, they stated that for US sellers, the only means of circumventing this “preventative” measure taken by them (again, this violation came from Amazon, not Apple) would be to obtain a form providing licensing of the “Lightning” patent to my company. This seems rather strange as Apple’s protocol for selling cords are clearly marked in their MFi Program .
Anyone who may have dealt with this prior or for anything similar in nature, any advice would be greatly helpful to myself and any of those who may deal with this in the future.
