Brand registered, trademark pending. Filed an infringement.

I’ve been selling a product since 2019. I filed for a trademark and got brand registered.

After a lengthy (and expensive) back and forth with USPTO, my attorney and I accepted going to the supplemental register (merely descriptive), and filing again for the same mark.

This year I’ve had 3 copycat products. I have filed infringements and Amazon has taken them down. But I got a threatening email from one, threatening to sue for loss of sales and damages, launching a class action with the other product owners, threatening to have Amazing delist my brand and list as generic and take it over etc. They gave a one day ultimatum.

My attorney is obviously enjoying thanksgiving which is fine.
