How is the category for your referral fee decided?

I have a product that is a clothing, but I want to sell it under the industrial and scientific category. It could count as both apparel/clothing or the industrial and scientific category. The difference between the two referral fees is $2.25, which is a lot. Does amazon charge me the referral fee for the category I list it under or do they decide themselves?
