Can I sell on a listing of a brand that is not trademarked?

I’m a new seller on amazon and I found a listing of a brand named “U-Miss”. This brand and seller is selling only 3 products and the brand is not trademarked. So can I safely sell on this listing or will the owner of the listing be able to kick me out of the listing?
