Why not just gate the entire New condition for all products?

I just got hit with my first IP complaint. While I’m dealing with this, I keep on wondering if you must purchase products from wholesalers/distributors to list products as New, then why doesn’t Amazon just gate the entire New condition?

It’d surely cut down on IP complaints brands would be filing. Why even allow sellers to list products in New condition without proper paperwork? It doesn’t make sense to me.
